The face off between music promoter, Happy Boys Entertainment Ltd. and Nigeria’s hip-hop crooner, 2face Idibia, are currently in a legal battle as the company has filed a suit before the Federal High Court, Lagos, alleging breach of contract.

Also joined in the suit filed on September 29, 2010, is Hypertek Entertainment Ltd, the artiste’s record label.
Reports show that the promoter in his Statement of Claim, had sought an order for the enforcement of the contract agreement dated Dec. 15, 2008. The plaintiff also prayed the court for a refund of N25m paid as consideration under the contract agreement.

In his affidavit, Mr Muritala Alade-Bamgbala, the CEO of the promotion company, alleged that the defendants granted him the exclusive right to market and distribute the album, ‘Unstoppable’ throughout West Africa.
He alleged that he made a payment of N25 million to the defendants being the sum agreed to under the contract. “I paid the total amount by cheque and was duly issued a receipt to that effect by the defendants,” he said.

Alade-Bamgbala, also alleged that upon the release of the album in March 2009, the company was neither notified nor given the opportunity to perform its obligation under the agreement. “I made several entreaties to the defendants to uphold their terms of the agreement to no avail. I was very shocked to hear that the album was already on sale and being marketed by agents of the defendants,” he said.

According to him, the defendants got the full worth of the plaintiff’s money and have converted it to personal use, disregarding the rules of the contract.

He urged the court, to declare the contract as a valid and binding agreement and that the defendants should perform their obligations.

The matter has been assigned to Justice Binta Murtala-Nyako, and comes up on March 28 for hearing.
